Sept. 16 First News: State's High Court To Consider Fate of Non-Binding Ballot Questions (Listen)

The state Supreme Court will consider whether New Mexico's largest county can put nonbinding questions about marijuana penalties and taxes on the November general election. The state’s high court has scheduled a hearing next Tuesday in a legal challenge by Bernalillo County. The court also issued an order to stop ballots from being finalized while the case is pending. Secretary of State Dianna Duran decided last week that advisory questions, like ones proposed by two counties, can't be placed on the ballot. Bernalillo and Santa Fe county commissioners have approved proposals to poll voters about their support for making possession of small amounts of marijuana a civil infraction.

The head of the Environmental Protection Agency says she's not backing down on her agency's efforts to implement a new rule that would assert regulatory authority over many of the nation's streams and wetlands despite criticisms that it amounts to a federal water grab. EPA Administrator Gina McCarthy made the comments Monday during a visit to New Mexico. She stopped in Corrales to commemorate a flood-control project that will be funded with two-million dollars in federal loans and grants. McCarthy says the Clean Water Act is more than 40 years old, and it's time to clarify which streams and waterways fall under its purview. She maintains the new rule would not increase the act's jurisdiction. The U.S. House last week passed a bill that would block the EPA from implementing the rule.

Neurologists and neurosurgeons at University of New Mexico Hospital can now help treat patients in rural communities, thanks to an expanding telemedicine program through the UNM Health Sciences Center. The Center recently received a 15-million dollar federal grant to test and expand a video network that is providing much-needed specialty care to rural New Mexico hospitals.

The program essentially brings UNM neuro specialists directly into rural emergency rooms via tele-health technology: *****1:53 Q: in your decision-making.”*****  UNM says through the ACCESS effort, a program-funded tele-health ambassador will train participating providers on the new technology.
